Default having been made in the terms of a certain Deed of Trust dated November 9, 2001 (corrected by Court Order recorded on June 25, 2021, as Instrument Number 210003158), in the original principal amount of $70,903.69 and recorded in the Clerk's Office of the Circuit Court of the County of Mecklenburg, Virginia on November 13, 2001, as Instrument Number 010005878, the undersigned Substitute Trustees will sell at public auction on November 30, 2021 at 1:00 PM, in front of the building housing the County of Mecklenburg Circuit Court, 393 Washington Street, Boydton, VA 23917, the property designated as containing 3 acres, bounded on the North and east by the lands now or formerly belonging to T.T. Short, on the South by the lands now or formerly belonging to Susie B. Jones, and on the West by the lands now or formerly belonging to Thomas W. Short; being the same property conveyed Edna Klasen by deed of William M. Clary, date May 7, 1991, recorded in the Clerk`s Office of the Circuit Court of Brunswick County, Virginia in Deed Book 255, Page 132 and in the Clerkâ€™s Office of the Circuit Court of Mecklenburg County, Virginia in Deed Book 549, Page 481. As a matter of information, the above-referenced deed described this property as being located in Meherrin Magisterial District, Brunswick County, Virginia. However, this property is located partially in Brunswick County and partially in Mecklenburg County, and is taxed for real estate purposes in Mecklenburg County, Virginia. TOGETHER WITH and SUBJECT TO all that certain easement or right of way over an existing road leading from the above-described property to State Route 639 to be used with others having a like right in going to and from the property hereinabove conveyed. Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises. TERMS: CASH. A deposit of $7,000.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder's deposit will be retained at the sale and applied to the sale price.
